The Georgia Open Records Law permits the public dissemination of arrest records in Fayette County. However, some arrest records may not be available to the public for privacy reasons. Unlike arrest records, criminal offender information is governed by the O.C.G.A § 35-3-37. Criminal offender information, including fingerprints or mugshots of the individual taken in relation to the arrest, is confidential.

Are Arrest Records Public Information in Fayette, Georgia?

Yes. The Georgia Open Records Law requires all arrest records to be open for personal inspection and copying. Anyone may request these records from the arresting law enforcement agency orally or in writing. Upon receiving a request, the agency will respond within three business days. The agency may charge a fee for producing arrest records. 

What Do Public Fayette County Arrest Records Contain?

Public arrest records in Fayette County typically contain the following information:

  • The inmates' first, middle, and last names
  • Inmates' sex, height, and weight
  • Arrest date, days in jail, custody status, and total bond
  • Warrant number, counts, statute, description, charge, and court

It is important to know that not all information in an arrest record is publicly available. According to O.C.G.A. § 50-18-72, public disclosure is not available for the following arrest records:

  • Arrest records relating to a pending investigation
  • Inmate medical records
  • Records whose disclosure would endanger a person's life or physical safety

Any records that will disclose:

  • Confidential source's identity
  • A confidential investigation or surveillance

Fayette County, Georgia Arrest Search

The Federal Bureau of Investigation (FBI) disseminates arrest records online, by mail, or through authorized channels for $18. However, only subjects of records are eligible to request arrest records from the FBI. Note that FBI records will only show information reported to the agency, so if a particular Fayette County arrest was not reported, it will not appear therein.

In addition, individuals can also seek a comprehensive Georgia criminal history search through the Fayette County Sheriff's Office for a fee. Only subjects of records or persons possessing the subject's written consent can request such records.

Active Warrant Search in Fayette County

A Fayette County arrest warrant is a judicial document that authorizes police to arrest an accused person. According to O.C.G.A. § 17-4-40, any magistrate, city, state, or superior court judge or magistrate may approve an arrest warrant for the arrest of an offender who violates penal laws based on probable cause. 

An arrest warrant may be issued in Fayette County even though the crime was committed in another county. Once an arrest warrant is issued, it may be executed in any county (O.C.G.A. § 17-4-44). How to Find Arrest Records for Free in Fayette County

The Fayette County Sheriff's Office provides an inmate search portal where record seekers may find arrest records for free. Users must enter the inmate's first and last name in the type search box. The search will return basic arresting and booking information about a current inmate. 

Free public resources for accessing arrest records often come with certain constraints, such as excluding expunged or older arrest information.

Fayette County Arrest Report

In Fayette County, an arrest report differs from an arrest record. An arrest report is a comprehensive document that contains the arresting officer's narrative of the arrest, witness testimony, evidentiary details, and probable cause information. On the other hand, an arrest record is a brief booking or custodial entry that includes the subject's name, charges, arrest date, booking number, and custody status. Generally, arrest reports may not be available to the public, whereas arrest records are public under the Georgia Open Records Act.

How to Get an Arrest Record Expunged in Fayette County 

In Georgia, the term "expungement" has been replaced with "record restriction," but the two terms mean the same thing. Record restriction involves sealing arrest information from general public access. Per O.C.G.A. § 35-3-37, restricted documents are accessible only to law enforcement for official criminal justice activities.

For arrests that occurred before July 1, 2013, applicants must complete the Request to Restrict Arrest Record Form, which has three sections. The applicant must complete section one, then mail the form to the arresting agency. Upon receiving the request form, the arresting agency will complete the second section and forward it to the prosecutor for approval or denial. The prosecutor must complete section three. 

If the prosecutor approves the application, they will enter the appropriate disposition restriction code using the GCIC (Georgia Crime Information Center) CCH (Computerized Criminal History) User Interface. The prosecutor will then notify the applicant and the arresting agency that the restriction has been completed. The GCIC will notify the applicant by email. 

There is no record restriction application process for arrests occurring on or after July 1, 2013. The prosecutor may approve a record restriction during sentencing. If this is the case, the prosecutor will note it in the sentencing documentation forwarded to the court. 

How Do You Remove Fayette County Arrest Records From the Internet?

When a Fayette County arrest record is restricted, the GCIC will notify the relevant law enforcement agencies to remove/delete the record from their databases. However, the GCIC has no control over information provided by third-party vendors. Individuals who want to remove their arrest records from third-party databases may choose to work with a lawyer or submit an opt-out request to the website(s) where their information appears.
